Channel 19: Government Access Goals and Policies
PROGRAM CONTENT: CCTV program services will cablecast regularly scheduled programs, produced or acquired by local, state or federal governments or any political subdivision thereof, which encourages citizens to take greater advantage of their opportunities to learn about and/or participate in government, civic, educational or recreational activities available in the Cañon City area. CCTV program services may also provide coverage of governmental town hall meetings, reports to citizens and other governmental events in the local area by elected local, state and national representatives whose constituencies include the citizens served by CCTV. CCTV may cablecast candidate forums for local or state offices in which all candidates have been given the opportunity to participate and when sponsored by a non-partisan and neutral entity which is not affiliated with any candidate or political party, e.g. Chamber of Commerce, Fremont Economic Development Corporation, and like organizations. CCTV will attempt to provide a variety of informational and educational programming, either produced by CCTV, or acquired by governmental subdivisions, which will contribute to the viewers’ understanding of health matters, social issues, cultural, educational or recreational opportunities, or will provide up-to-date information on the workings of local, state, and national government such as new or revised laws or ordinances, administrative procedures, civic improvements projects, educational issues or related matters.
RULES AND PROCEDURES: Videotaped rebroadcast of the public meeting of various councils, boards and commissions are not to be construed as being official minutes of those meetings. These cablecasts are presented only for the convenience of interested citizens and may not be complete. The official minutes of the meetings are available from the respective clerk or secretary of the specific council, board or commission. During videotaped rebroadcasts of these meetings, “gavel-to-gavel” coverage will be provided as much as possible. Since, during some public meetings, both elected officials and interested citizens are provided the opportunity to express their views on issues before the council, board or commission, special program time for editorial comments by those in favor or in opposition to any actions taken by the council, board or commission will not be provided for by CCTV. Videotaped rebroadcasts of public meetings will be scheduled so as to provide opportunities for citizens to view the program. No advertising or announcements by commercial firms soliciting business in any form will be accepted; however, contributed sponsorships of a program which otherwise qualifies for programming may be accepted. Public announcements, safety bulletins and emergency messages issued by local or state public safety agencies will receive priority time on CCTV. The amount of time each announcement appears on CCTV will be determined by station personnel based on the time and space available on CCTV. Locally-Produced Programming - CCTV will endeavor to produce regular programming, educational in nature, which keeps citizens informed on the progress of civic improvement projects, assists in the elimination of crime and other public hazards and highlights events of general public interest. In addition, CCTV will on occasion produce programs of educational value to promote citizen participation in recreational and cultural activities within the Cañon City area. State Law prohibits the use of public funds to produce, or cause to be produced, programming which take a position for or against any public issues that will be decided in an election. Programming – All programming shown on CCTV shall relate to services, programs, issues, events, information or activities of the City, other government or governmental agency, subdivision or unit. All election programming shall comply with United States Federal Communications Regulations (47 C.F.R. §76.205 et seq., subpart G “Cable casting”). CCTV shall not exercise any editorial control over any election program. Should more than one organization wish to sponsor or produce such programming, CCTV shall exercise its best efforts to fairly and impartially accommodate all such requests. All programming shown on CCTV is subject to the availability of funds and CCTV staff, equipment, facilities and time. CCTV shall, in its sole discretion, have the right to refuse to air any program, spot or other multimedia programming. Programming that is shown shall be aired according to the following order of priority:
Videotaped meetings and programs are subject to repeat airings. Any such repeat airing shall be at the sole discretion of CCTV. Any person who wishes to have a public service announcement or election bulletin board message shown on CCTV shall submit the proposed announcement or message in writing to CCTV at least five (5) working days in advance of the proposed first date of airing. CCTV shall have the right to refuse to run any message or announcement that, in CCTV’s sole discretion, it considers inappropriate for the City’s government access channel. CCTV shall have the right to re-evaluate and/or change its programming at its sole discretion. Before a program or other spot produced or prepared by someone other than CCTV is scheduled for cable casting, it shall be reviewed by CCTV to determine whether it meets the minimum technical and broadcast aesthetic standards established by CCTV. Whether the program or other spot meets those standards shall be determined exclusively by CCTV. No commercial or advertising material may be included in any such program or spot. CCTV shall have the right to edit the program or other spot so long as the editing does not alter the factual content or overall intent of the material. When, at its sole discretion, CCTV determines that a program requires a disclaimer, the disclaimer shall read as follows: “The views expressed in the following program are not necessarily those of CCTV or its staff or the City of Cañon City, its City Council or employees”. No defamatory, slanderous, lewd, obscene or violent material or language will be allowed on CCTV. CCTV shall, at its sole discretion, determine whether any material or language is slanderous, lewd, obscene or violent and, with respect to the use of any matter, subject to copyright, whether all applicable laws have been met. Any request for a review of that determination shall be made and handled as provided above; any reference therein to “the disposition” shall, for purposes of this section, mean CCTV’s determination as to whether the material or language is slanderous, lewd, obscene or violent. Nothing contained herein is intended, nor shall it be construed, to create a public forum, or limited public forum, for purposes of First Amendment rights under the Federal Constitution or Section 10, Article II, or rights under the Colorado Constitution. No program aired on CCTV shall contain any matter, the use of which is subject to copyright, unless compliance with all applicable laws is established to CCTV’s satisfaction. Viewer Complaints – Any viewer may register a verbal complaint about a program cablecast on CCTV by calling City Hall at 269-9011. CCTV shall respond as quickly as practicable to any complaining viewer who left a phone number and/or address. If the complaint is not resolved to the satisfaction of the viewer, the viewer may submit a written complaint as described below. A viewer may submit a written complaint to CCTV, P. O. Box 1460, 612 Royal Gorge Blvd., Cañon City, CO 81215, concerning any program that is shown on CCTV. In order to be considered, any such written complaint shall be submitted no later than seven (7) days after the program is aired or CCTV responds to the viewer’s verbal complaint, whichever occurs later. The written complaint shall state the date and time the program was shown, the name of the program and the complaint. CCTV shall, as soon as practicable, advise the viewer in writing of the disposition of the complaint. If the viewer is not satisfied with the disposition of the complaint, the viewer may request a review of the matter by the City Council. When relevant to the viewer’s complaint, CCTV shall apply the following criteria in reaching a determination concerning a disposition of the complaint:
The right to seek review as set forth above shall be the viewer’s exclusive administrative remedy. While the complaint and/or review process is pending, CCTV shall have the right to continue or discontinue the cable casting of the program(s) which is the subject of the viewer’s complaint. Neither CCTV nor the City shall consider a similar complaint made by the same viewer on the same program or material within one (1) year after the date the viewer made the original complaint. No viewer shall have any right to seek review of a decision made by CCTV or the City Council concerning the applicability of this provision. Production of Programming for Third Party – CCTV may have the right to produce programming for another party if all the following conditions are met:
Half of the fees due shall be paid to CCTV when the production is ordered and the balance shall be paid at, or before, the time CCTV delivers the final programming to the party. CCTV shall, at its sole discretion, have the right to refuse to produce any programming for a third party. CCTV shall have no obligation to air any such programming on Cañon City’s government access or other channel. Rental of Program – Upon payment to CCTV of a $25 refundable deposit, any party may rent any program produced by CCTV that CCTV makes available for rental. The party shall, within 72 hours, return the program to CCTV or CCTV shall retain the party’s $25 deposit. The party renting the program shall pay a $25 deposit for each videotaped program rented. Tape Duplication – If, at its sole discretion, CCTV determines that it has available staff, equipment, facilities and time, upon request it may, at no charge, duplicate a tape so long as all the following conditions are met:
Sponsorship in General – No advertisement shall be shown on CCTV. For purposes of this policy, “advertisement” shall mean any message or other programming material which is cablecast or otherwise transmitted in exchange for any remuneration, and which is intended: 1) to promote any service, facility or product offered by any person who is engaged in such offering for profit, or 2) to support or oppose any candidate for political office. Each sponsor acknowledgement shall be produced by CCTV. Length, content, order and sequence or appearance of acknowledgements shall be determined solely by CCTV. Contributions of sponsors may be made in the form of money and/or in-kind services, equipment and/or supplies approved in advance by CCTV. Sponsorships shall be non-exclusive except as provided herein. Levels of Sponsorship – A contribution of $2,000 or more shall be considered a Platinum Sponsorship which shall entitle the sponsor to recognition of the contribution in the following ways:
A contribution of $500 or more but less than $1,999 shall be considered a Gold Sponsorship which shall entitle the sponsor to recognition of the contribution in the following ways:
A contribution of $250 or more but less than $499 shall be considered a Silver Sponsorship which shall entitle the sponsor to recognition of the contribution in the following ways:
Special Sponsorship – Contributions can be made for the expenses associated with buying or producing programs to be shown on CCTV. At its sole discretion, CCTV shall determine whether it has available the funds, staff, equipment, facilities and time to produce or air any such program. Any such program shall become the property of CCTV. A sponsor who wishes to contribute an amount equal to the expenses of the production of a program shall:
A sponsor who wishes to buy a program to be shown on CCTV or contribute the cost of purchasing the program shall:
A sponsor who contributes to the production or purchase of a program in an amount less than the full cost thereof shall receive an acknowledgement as a partial contributor each time the program is aired on CCTV, including any recablecasts of the program, for one (1) year after the date of the sponsor’s contribution (such acknowledgement shall be in the form of a graphic only which shall be prepared by CCTV and at CCTV’s sole discretion, run at the beginning or conclusion of the program, or both). Nothing contained herein is intended to amend, alter or modify Cañon City’s policy on programming and use of Cañon City’s government access cable channel. Failure on the part of CCTV or the City of Cañon City to comply with any of the provisions contained herein shall not be construed to create any benefit or right enforceable as a breach of contract or other legal action against CCTV or the City of Cañon City. Any such failure shall be remedied by CCTV as it considers appropriate at its sole discretion. |
